A vacation rental agreement isn't just an administrative formality. It's the document that sets the rules between you and your guest. It governs the duration, the price, the security deposit, the cancellation terms — and most importantly, it protects you if something goes wrong. Even when you go through a platform like Airbnb, a rental agreement remains the reference document before a court.


Vacation rental agreement vs standard lease: what's the difference?

This is the first question to get right, because the rules are fundamentally different.

The vacation rental: temporary by definition

A vacation rental agreement is governed by the law of obligations, not housing tenancy law. This has major consequences:

  • No minimum duration: you can rent for 1 night, 1 week, or 3 months
  • No tenant protection: unlike a standard lease, the guest cannot claim occupancy rights
  • Full flexibility: you set the price, conditions, and cancellation policy
  • No rent control: your pricing is entirely free

The legal definition of a vacation rental: a furnished property rented to a transient clientele who stay for a short period (typically less than 90 consecutive days) and do not establish it as their main residence.

When does it become a standard lease?

The boundary is important: if the same person occupies your property for more than 90 consecutive days, or if they register it as their main address, the relationship may be reclassified as a furnished residential lease — with all the tenant protections that entails.

Keep stays short, don't allow permanent address registration, and include this explicitly in your agreement.


Mandatory clauses in a vacation rental agreement

These are the minimum clauses required for your agreement to be legally valid.

1. Identity of both parties

Full legal names, addresses, and contact details for:

  • You (the host/owner or their authorised representative)
  • The guest (the person signing, who is the lead guest)

2. Complete property description

  • Full address
  • Type of property (house, apartment, cottage, studio)
  • Total surface area
  • Number of rooms
  • Exact location within a building if applicable

3. Rental duration

  • Check-in date and time
  • Check-out date and time
  • Any specific arrival/departure conditions

Never leave the duration vague. "A week in August" is not a legal duration.

4. Rental price

  • Total rental price for the entire stay
  • Breakdown if applicable (rental + linen hire + tourist tax)
  • Payment method and schedule

5. Maximum occupancy

The maximum number of guests authorised to occupy the property. This clause is crucial: it's your legal basis if guests bring more people than agreed.

6. Deposit / security deposit

The amount held as security, conditions for retention, and deadline for return (see full section below).


Recommended clauses (not mandatory, but essential)

House rules

Reference your house rules in the agreement (or attach them as an annex). These include:

  • No smoking (inside, on balconies)
  • Pets: allowed / not allowed / allowed with prior approval
  • No parties or events
  • Quiet hours
  • Outdoor space usage

By making the rules part of the signed agreement, you have a legal basis to pursue compensation or retain the deposit if they're broken.

Right of access

As the owner, you have the right to access the property in case of emergency or reported damage. State this in the agreement, along with reasonable notice requirements (24–48 hours except emergencies).

Condition at check-out

List what you expect from guests at departure: rubbish out, dishes clean, windows closed, keys returned. This prevents disputes about what "leaving it as you found it" means.

Subleasing prohibition

Explicitly prohibit the guest from subletting the property to third parties or listing it on other platforms during their stay.


Security deposit: how to do it right

The security deposit (also called damage deposit or caution) is your main protection against damage. Here's how to handle it correctly.

Recommended amount

Typically 20–30% of the total rental price, with a minimum of £150–200 for short stays. For luxury properties or extended stays, it can go higher.

There's no legal maximum for vacation rentals in most jurisdictions — but set it at a level guests will actually accept.

Collection methods

  • Cheque held uncashed: traditional method, but increasingly inconvenient for guests (especially international ones)
  • Bank transfer: more practical, but creates a float you need to manage
  • Credit card pre-authorisation: the most professional approach — the amount is blocked on the guest's card but not charged unless you make a claim. Services like Swikly or Superhog offer this for independent rentals.

When to return it

Return the deposit within 7–10 days of checkout, once you've verified the property. The longer you hold it without justification, the harder it is to defend if challenged.

If you're making a deduction: document everything with dated photos taken immediately after checkout, before any cleaning, and send the guest a detailed written explanation with invoices or repair quotes.


Inventory check-in and check-out

The inventory (état des lieux) is your evidence if something goes wrong. Without it, proving damage is extremely difficult.

What to document

  • Every room, including storage areas
  • All appliances (working or not, existing scratches)
  • Furniture condition
  • Crockery and utensil counts
  • Outdoor furniture and garden equipment

How to do it

Use photos and a written form. Both you and the guest should sign the check-in inventory. If the guest refuses to sign or isn't present, document this in writing and photograph everything before handing over the keys.

At check-out, go through the same process. Any new damage appears clearly by comparison.

A simple shared Google Doc or a dedicated app works well. The key is having it signed by both parties.

Airbnb / Booking.com: do you still need a rental agreement?

Yes — and here's why.

Airbnb's Terms of Service explicitly state that they govern the relationship between Airbnb and the user, not between host and guest. In the event of a serious dispute, a judge will look at the direct agreement between the two parties.

AirCover provides some protection, but it has limits: it doesn't cover all damage types, the claims process can be slow, and it doesn't replace the legal enforceability of a signed contract.

The platform booking confirmation is proof of the reservation — not a legal rental agreement.

Many experienced hosts include their rental agreement as a PDF in their pre-arrival message to guests. It sets a professional tone and makes expectations crystal clear from the start.

FAQ: vacation rental agreements

Is a vacation rental agreement legally required?

Legally, no — there's no statutory requirement in most jurisdictions to have a written rental agreement for vacation lets. But without one, you have no written evidence of the agreed terms in the event of a dispute. Practically speaking, it's essential protection.

Can I use Airbnb's booking confirmation as my agreement?

No. Airbnb's confirmation documents the booking transaction between Airbnb and the guest. It doesn't constitute a legal rental agreement between you and the guest, and won't carry the same weight in a legal dispute.

What if a guest refuses to sign?

If a guest refuses to sign before check-in, you're within your rights not to hand over the keys. In practice, if you send the agreement in advance and make signing a clear condition of arrival, refusals are extremely rare.

How do I collect the security deposit for international guests?

Credit card pre-authorisation is the cleanest solution for international guests. Services like Swikly, Superhog, or Chekin offer this for vacation rentals. The amount is blocked on the card but never actually charged unless you make a claim within the agreed window.

Can I keep the security deposit for light cleaning?

Only if the property was left in a clearly worse state than when the guest arrived, and you can document it. Normal cleaning (after a normal stay) should be covered by your cleaning fee, not the deposit. Retaining a deposit for anything less than documented damage or rule breaches is likely to be challenged.
